Terms of Service & Privacy Policy

These Terms of Service (“Terms”) govern your access to and use of Instituto Neumair, including any associated websites, applications, APIs, chat interfaces, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Instituto Neumair provides an AI-powered educational and bibliographic research tool intended exclusively for licensed professionals. The Service synthesizes peer-reviewed academic literature, organizes information administratively, and surfaces references for your independent review.

Important: The Service is not medical advice, a diagnostic tool, a treatment recommendation system, a medical device, software as a medical device (SaMD), or any form of regulated clinical technology. It does not provide diagnoses, prescriptions, treatment plans, or clinical decisions. All responsibility for professional judgment and patient care remains solely with you, the licensed user.

2. Eligibility and Account

You must be at least 18 years old and, where applicable, a licensed professional in your jurisdiction to use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3. Access Levels

Plan	Description
Free	Basic access with limited features and no conversation history retention.
Standard	Conversation history, basic customization, and standard support.
Premium	Advanced educational reports, case organization, API access, priority support. All outputs remain educational references only.

All plans are restricted to licensed professionals. Misrepresentation of credentials may result in immediate termination.

4. Conversation and Data Deletion

When you delete an individual conversation, session, or your entire account:

The content is immediately removed from your account and from our systems.
Deletion is instant, permanent, and unrecoverable.
Once you delete it, the data is gone forever — we do not keep backups, recoverable copies, archives, or logs of the deleted content.
There is no mechanism for restoration or recovery by you or Instituto Neumair after deletion.

We do not retain any recoverable version of your deleted conversations or sessions under any circumstances.

5. Disclaimers and Limitation of Liability

The Service and all Content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind.
AI-generated Content may contain inaccuracies, biases, hallucinations, or omissions. You must independently verify all information against primary sources.
Do not rely on the Service for clinical decisions, emergencies, high-stakes situations, or any purpose requiring guaranteed accuracy.
To the maximum extent permitted by law, Instituto Neumair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or USD $100 if no payment was made).
You agree to indemnify and hold Instituto Neumair harmless from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

6. Intellectual Property

All rights, title, and interest in the Service (including software, models, trademarks, and documentation) remain with Instituto Neumair. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended educational purpose only.

7. Acceptable Use

You may not use the Service to violate laws, infringe rights, input sensitive personal data without legal basis, or engage in abusive, fraudulent, or harmful conduct. Violations may result in immediate suspension or termination.

8. Termination and Changes

We may suspend or terminate your access at any time for violations or operational reasons. We may update these Terms; continued use after notice constitutes acceptance.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles. Any disputes shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (or equivalent neutral body) in a mutually agreed location, with no class actions or jury trials permitted.

Instituto Neumair is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and delete personal data when you use the Service.

Data We Collect

Account information (name, email, credentials you provide)
Usage data (interactions, timestamps)

We do not intentionally collect sensitive personal data (health, biometric, racial, etc.). You must not input such data.

How We Use Data

To provide, maintain, improve, and secure the Service. We do not use your conversation data to train AI models unless you give explicit separate consent.

Data Sharing

We do not sell your data. We share only with service providers (e.g., payment processors like Paddle) under strict contracts, or when required by law.

Data Deletion

See Section 4 of the Terms of Service above. When you delete conversations or your account, the data is immediately and permanently erased from our systems with no recoverable copies retained.

Your Rights

Depending on your location, you may have rights to access, correct, delete, or port your data. Contact privacy@ineumair.com to exercise these rights.

International Transfers

Data may be processed in countries outside your jurisdiction. We use appropriate safeguards (e.g., standard contractual clauses) to protect it.
